Terms of Service — Padierna Turnkey Rentals

These terms apply when you use our website, request a quote, or book work with Padierna Turnkey Rentals, a Texas Walls company ("Padierna Turnkey Rentals," "we," "us"). "You" means the person or company booking the work. By booking or paying, you agree to these terms. If your written quote or signed agreement says something different, the quote or agreement controls.

1. What we provide

We provide a Cat 255 compact track loader (or a similar machine) together with our own operator for work in North Texas. This is a "wet lease": the machine and operator come as a package. Typical work includes dirt work, trenching, auger work, building pads, driveway prep, drainage, fence post holes, and landscaping.

We run the machine only. We do not do plumbing or electrical connections, set regulated utilities, or pull permits. Your licensed trades handle that work.

2. Pricing

  • Hourly rate: $125 per hour, machine and operator
  • Minimum: 8 hours per booking ($1,000)
  • Delivery: $250 per booking
  • Full day: $1,250 ($1,000 for the 8-hour day + $250 delivery)
  • Hours beyond 8 are billed at $125 per hour.
  • Longer leases (for example, 3 months or more) and fixed-price jobs are priced by written quote. We don't offer fixed-price quotes under $3,500; that work is booked as a day rental.
  • Taxes, fuel, extra trips, or special conditions are charged only as shown on your quote.

3. Booking and payment

  • Day rentals: a booking is confirmed only after full payment is received in advance, before delivery. The first day is $1,250, which includes the one-time $250 delivery, and each extra day is $1,000. All booked days are paid in advance.
  • Fixed-price jobs up to $20,000: 50% deposit to schedule and 50% due on completion. Payment terms for larger jobs are set in the written quote.
  • Payments are processed securely by Stripe. By paying, you also agree to Stripe's terms.
  • Extra hours, or charges agreed on site, are invoiced after the job and are due on receipt.
  • If a payment fails or is reversed, we may cancel or pause the booking.

4. Cancellation and rescheduling

Cancellation and rescheduling. You can cancel or reschedule for free up to 48 hours before scheduled delivery. If you cancel within 48 hours of delivery, we keep the $250 delivery fee and refund or credit the rest. Once the machine has been dispatched to your site, the first day is non-refundable.

5. Your responsibilities: site access and utilities

You agree to: - Call Texas 811 before any digging. You (or your contractor) are responsible for requesting utility locates through Texas 811 (dial 811 or visit texas811.org) at least 2 business days before work starts. You must also keep the marks in place. - Mark private lines that 811 does not locate, such as sprinkler/irrigation lines, septic systems and fields, private water, gas, or electric lines, low-voltage and lighting wires, and pool equipment. - Give safe, legal access to the work area for our truck, trailer, and machine, including gates, clearance, and a place to unload. - Own the property or have written permission to work there, and handle any permits, HOA approvals, and property-line questions. - Tell us about known hazards, such as soft ground, buried tanks, slopes, overhead lines, or contamination. - Keep people, pets, and vehicles clear of the machine while it is working.

We are not responsible for damage to utilities or buried items that were not marked or disclosed. Normal track marks, ruts, or wear on lawns, soil, or unpaved surfaces from reaching and working the site are part of the job.

6. Weather and site conditions

Our operator decides whether it is safe to work. We may delay, stop, or reschedule for rain, wet or unstable ground, lightning, high winds, extreme heat or cold, or other unsafe conditions. If weather prevents delivery, we will reschedule with you. If weather stops work after the machine is delivered and fewer than 2 hours have been worked that day, we move that day to a new date at no charge. If 2 or more hours have been worked, the day is billed at the normal rate.

7. Operator-only operation

  • Only our operator may run the machine. You and your crew may not operate, ride on, or move it.
  • Our operator may refuse any task that is unsafe, illegal, or outside what the machine is built to do.
  • The machine will not be used to lift or carry people.
  • If anyone other than our operator uses the machine, you are responsible for any resulting damage, injury, or loss.

8. Limitation of liability

To the fullest extent allowed by Texas law: - Our total liability for any claim related to a booking is limited to the amount you paid us for that booking. - We are not liable for indirect, incidental, special, or consequential damages, such as lost profits, delay costs, or schedule impacts. - Nothing in these terms limits liability for gross negligence, willful misconduct, or anything that cannot be limited by law.

You agree to cover (indemnify) us for claims, costs, and damages caused by your breach of these terms, by unmarked or undisclosed site conditions, or by the actions of your crew or other contractors on site.

9. Text messages (SMS)

If you agree to receive texts from Padierna Turnkey Rentals, we may text you about quotes, bookings, delivery, payment, and follow-ups, and occasional offers if you agreed to them. Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help. Consent to texts is not a condition of purchase. Carriers are not liable for delayed or undelivered messages. We do not share mobile numbers with third parties for their marketing. See our Privacy Policy for details.

10. Website use

Information on our website is general and may change. Prices and availability are confirmed on your written quote or booking. Please don't misuse the website, for example by sending spam or trying to break its security.

11. Governing law

These terms are governed by the laws of the State of Texas. Any dispute will be handled in the state or federal courts located in Collin County, Texas, unless we both agree otherwise in writing.

12. Changes

We may update these terms. The version posted on this page when you book applies to that booking.
